More than 143 million American workers are protected by the Fair Labor Standards Act (FLSA), the federal law that establishes minimum wage, overtime pay, recordkeeping, and youth employment standards.

Under the FLSA, covered nonexempt workers are entitled to a minimum wage of not less than $7.25 for all hours worked and overtime pay at a rate not less than one and one-half times the regular rate of pay is required after 40 hours of work in a workweek.

In 2024 the US DOL's Wage and Hour Division recovered more than $37 million in back wages for workers in the health care industry.  To help employers stay in compliance with the FLSA, this presentation will provide an overview of the main compliance principals of the FLSA and take a deeper look at hours worked principles under the Act.  Topics include employment relationships, what are hours worked under the FLSA, and how to calculate overtime pay, recordkeeping requirements.

Danielle Calderon, Community Outreach and Resource Planning Specialist, Wage & Hour Division, US Department of Labor

Danielle Calderon is the Community Outreach and Resource Planning Specialist (CORPS) for the Wage & Hour Division’s Ohio District Office.  Danielle began her career in 2011 as a Wage Hour Investigator.  Over the last decade she has acted as a subject matter expert on the laws enforced by the Wage & Hour Division, including:  the Fair Labor Standards Act and the Davis Bacon and Related Acts.  Danielle began working as the CORPS for the Ohio in 2022 and strives to provide outreach and education to stakeholders throughout the state.
