Comprehensive Fair Labor Standards Act (FLSA) and Record Keeping

Thursday, April 11, 2024 (10:00 AM - 11:30 AM) (EDT)

Description

This is a free webinar for OCHCH & OCHN Members.

More than 143 million American workers are protected by the Fair Labor Standards Act (FLSA), the federal law that establishes minimum wage, overtime pay, recordkeeping, and youth employment standards. Under the FLSA covered nonexempt workers are entitled to a minimum wage of not less than $7.25 for all hours worked and overtime pay at a rate not less than one and one-half times the regular rate of pay is required after 40 hours of work in a workweek.

In 2023 the US DOL's Wage and Hour Division recovered over $10.3 million in back wages for workers in the health care industry. In order to help employers stay in compliance with the FLSA, this presentation will provide an overview of the law, with a focus on common compliance issues found in the care industry. Using real world examples, we will explore a variety of topics, including determining employment relationships, calculating hours worked under, how to compute overtime pay, and recordkeeping requirements.

Objectives:

  • Calculate hours worked under the Fair Labor Standards Act, including drive time, sleep time, training  time, and breaks of short duration.
  • Calculate overtime payments for workers.
  • Have a better understanding of the basic provisions of the FLSA, including minimum wage, recordkeeping, and youth employment.
