The Family and Medical Leave & PUMP Acts - FLSA Protections for Employees

July 16, 2024 10:00 AM - 11:30 AM (EDT)

This is a free webinar for OCHCH & OCHN Members.

For over thirty years, the Family and Medical Leave Act (FMLA) has offered millions of workers protected leave to care for their families and tend to their own health.  Enacted in 1993, the FMLA entitles eligible employees of covered employers to take up to 12 workweeks of leave per year for qualifying family and medical reasons and up to 26 workweeks of military caregiver leave during a single 12-month period.  Employees who use FMLA leave have the right to go back to work at their same job or to an equivalent job that has the same pay, benefits, and other terms and conditions of employment at the end of their FMLA leave.

The right to pump at work has been available to employees since 2010 when the Fair Labor Standards Act (FLSA) was amended by the Affordable Care Act to include Break Time for Nursing Mothers provisions.  On December 29, 2022 the PUMP Act was signed into law and as a result expanded those protections to more workers.  Under the FLSA employers are required to provide reasonable break time and adequate space for nursing employees to pump at work.  This right is available for up to one year after their child’s birth.

The WHD is committed to elevating awareness, accessibility, and education on the FMLA, FLSA, and the PUMP Act. To that end, this presentation will provide a comprehensive overview of these laws using real world examples to highlight common compliance concerns such as what are qualifying reasons for workers to talk leave under the FMLA and what are the space requirements for nursing workers under the FLSA.  We will also show you how to find the most up to date resources and information to help you stay in compliance.

Learning Objectives for Attendees

  • Identify when employees have a potential qualifying need for family medical leave.
  • Have a better understanding of common violations of the FMLA and how to avoid them.
  • Identify the requirements to determine if a business is subject to the FLSA and federal nursing mothers provisions.
  • Understand federal requirements for employers to provide break time and space for nursing workers.
